Terms of Service for Pottys Plus

These Terms of Service (“Terms”) govern your use of www.pottysplus.com and all portable restroom rental and related services (“Services”) provided by Pottys Plus (“Company,” “we,” “our,” or “us”). By using our website or Services, you agree to these Terms.

1. Services Provided

Pottys Plus provides portable restroom rentals, handwashing stations, sanitation solutions, and related services for events, job sites, and organizations.

2. Quotes and Orders

Quotes are estimates and subject to change based on final site conditions and service needs.
Orders are confirmed upon receipt of payment or signed agreement.
Customers are responsible for providing accurate delivery information.

2a. Customer Responsibilities

Customers must ensure safe, accessible placement for units, including adequate site access, ground stability, and any necessary permits.
Customers are responsible for keeping units accessible for scheduled servicing.
Pottys Plus is not responsible for delays, inability to deliver, or additional charges caused by inaccessible or unsafe conditions.

3. Payments and PCI Compliance

Payment is due prior to delivery unless otherwise agreed in writing.
We accept major credit cards, checks, and other approved payment methods.
Online payments are processed via PCI-DSS compliant gateways.
Pottys Plus does not store or retain complete credit card numbers.
Late payments may result in service suspension, additional charges, or collection actions.

4. Delivery and Use

Units must be placed within 15 feet of a serviceable area accessible to our trucks.
Customers must protect rented equipment from damage, misuse, theft, or vandalism.
Hazardous or non-sanitary materials may not be disposed of in any unit.

4a. Damage and Replacement Costs

Customers are responsible for repair or replacement costs if units are lost, stolen, or damaged beyond normal wear and tear. Charges may include cleaning fees for misuse.

5. Maintenance and Servicing

Rentals include weekly cleaning, sanitization, and restocking.
Extra servicing may be requested for an additional fee.
Customers must not attempt to move, service, or tamper with units themselves.

6. Cancellations and Refunds

Cancellations must be received at least 48 hours before scheduled delivery.
Refunds may be reduced to cover administrative or transportation costs already incurred.

7. Limitation of Liability

Pottys Plus’ liability is limited to the amount paid for the affected rental or service. We are not responsible for:

Damages caused by misuse or customer negligence
Delays outside our control (weather, traffic, accidents, etc.)
Indirect, incidental, or consequential damages

7a. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, strikes, labor shortages, accidents, or government actions.

8. Indemnification

You agree to indemnify, defend, and hold harmless Pottys Plus, its employees, and contractors from any claims, damages, or liabilities arising from misuse of equipment, violation of these Terms, or failure to comply with applicable laws.

9. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles.

10. Changes to Terms

We may update these Terms from time to time. Any changes will be posted on our website with a new effective date. Continued use of our Services constitutes acceptance of the updated Terms.

11. Eligibility and Age Requirement

You must be at least 18 years old or have legal authority on behalf of an organization to place orders with Pottys Plus.

12. Termination of Service

Pottys Plus reserves the right to suspend or terminate Services for:

Non-payment
Unsafe or inaccessible conditions
Misuse or unlawful use of equipment

13. Dispute Resolution

Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be settled exclusively in the state or federal courts located in New Jersey.
