Pottys Plus Sanitation Regulations & Compliance Guide
At Pottys Plus, we take compliance seriously. Our portable toilet rentals, restroom trailers, and handwash stations meet all OSHA, ADA, ANSI/PSAI, and New Jersey DEP requirements. Below is a clear overview of the key regulations that affect construction sites, agricultural operations, special events, and general public use.
Construction Site Sanitation (OSHA 29 CFR 1926.51)
≤ 20 workers: 1 toilet, 20–199 workers: 1 toilet seat and 1 urinal per 40 workers, ≥ 200 workers: 1 toilet seat and 1 urinal per 50 workers
Toilets must be available whenever employees need them; employers may not impose unreasonable restrictions .
Privies (if groundwater won’t be contaminated), chemical toilets, recirculating toilets, or combustion toilets are allowed where sewer connections are not practical .
Required if workers handle harmful substances such as paints, coatings, herbicides, or insecticides. Must include running (tepid) water, soap, and single-use towels .
Industry guidelines recommend 1 unit per 10 workers for a 40-hour workweek (not a legal minimum, but a productivity and hygiene standard recognized by PSAI/ANSI) .
Agricultural & Farming Sanitation (OSHA Field Sanitation, 29 CFR 1928.110)
- Applies to farms with 11+ field workers
- Minimums: 1 toilet + 1 handwash station per 20 workers.
- Must be within ¼-mile of the worksite (or nearest vehicular access).
- Handwashing must include: potable water, soap, and single-use towels.
- Not required if total field work (including travel) is ≤ 3 hours/day .
Special Events & Food Service (NJ Food Code – NJAC 8:24)
Temporary food vendors must have dedicated handwashing sinks (not mop or dish sinks).
Handwashing stations must provide soap, running water, and paper towels.
Local health departments issue permits and may set specific restroom-to-guest ratios .

Accessibility (ADA Regulations)
- At least 5% (no fewer than one) of portable toilets in each cluster must be ADA-accessible.
- Accessible units must allow wheelchair turning radius and be clearly marked with the International Symbol of Accessibility.
- Note: ADA requirements apply to public use clusters; construction site-only facilities are exempt .
Waste Transport & Disposal (NJDEP Requirements)
- Portable restroom waste is regulated as Type 73 – Septic Tank Clean-Out Waste.
- Only NJDEP-registered haulers may transport this waste. Haulers must display valid decals on vehicles and dispose of waste at approved facilities.
- Pottys Plus partners exclusively with NJDEP-registered transporters, ensuring compliance with all state regulations.
ANSI / PSAI Standards
The American National Standards Institute (ANSI) and the Portable Sanitation Association International (PSAI) set important industry standards that go beyond OSHA and ADA minimums. These standards guide the number, placement, and maintenance of portable sanitation units.
ANSI/PSAI Z4.3 – Sanitation: Nonsewered Waste Disposal Systems at Places of Employment
Covers portable toilets at job sites where sewer/septic connections are not available. Ensures workers have safe, sanitary facilities and sets requirements for cleaning and servicing.
ANSI/PSAI Z4.4 – Sanitation: Nonsewered Waste Disposal Systems for Use by the General Public
Applies to portable toilets at public events, parks, and recreation sites not connected to sewer or septic. Focuses on protecting public health and the environment.
